BY PURCHASING ANY SERVICE, WE ASSUME YOU ACCEPT THESE TERMS AND CONDITIONS IN FULL. DO NOT CONTINUE TO USE C & W AUTOMOTIVES IF YOU DO NOT AGREE TO ALL OF THE TERMS AND CONDITIONS STATED ON THIS PAGE.

THE FOLLOWING TERMINOLOGY APPLIES TO THESE TERMS AND CONDITIONS, PRIVACY STATEMENT AND DISCLAIMER NOTICE AND ANY OR ALL AGREEMENTS: “CUSTOMER,” “YOU” AND “YOUR” REFERS TO YOU, THE PERSON ACCESSING THIS WEBSITE AND PURCHASING A SERVICE AND ACCEPTING THE COMPANY’S TERMS AND CONDITIONS. “THE COMPANY,” “OURSELVES,” “WE,” “OUR” AND “US,” REFERS TO OUR COMPANY. “PARTY,” “PARTIES,” OR “US,” REFERS TO BOTH THE CUSTOMER AND OURSELVES, OR EITHER THE CUSTOMER OR OURSELVES.

All terms apply to the offer, acceptance, and consideration of payment necessary to undertake the process of our assistance to the Customer in the most appropriate manner, whether by Diagnostic or customer meetings of a fixed duration, or any other means of service, for the express purpose of meeting the Customer’s needs in respect of provision of the Company’s stated services/products, in accordance with and subject to, prevailing law of United States. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same.

We (C&W Automotives) employ the use of cookies. By using the C & W Automotives website, you consent to the use of cookies in accordance with C & W Automotives privacy policy. Most of the modern-day interactive websites use cookies to enable us to retrieve user details for each visit. Cookies are used in some areas of our site to enable the functionality of this area and ease of use for those people visiting. Some of our affiliate/advertising partners may also use cookies.

We (C&W Automotives) will consider requests to remove links but will have no obligation to do so or to respond directly to you. Whilst we (C&W Automotives) endeavor to ensure that the information on this website is correct, we (C&W Automotives) do not warrant its completeness or accuracy; nor do we (C&W  Automotives) commit to ensuring that the website remains available or that the material on the website is kept up to date.

Liability

        We (C&W Automotives) shall have no responsibility or liability for any content appearing on your Web site. You agree to indemnify and defend us against all claims arising out of or based upon your Website. No link(s) may appear on any page on your Web site or within any context containing content or materials that may be interpreted as libelous, obscene or criminal, or which infringes, otherwise violates, or advocates the infringement or other violation of, any third party rights.

        We (C&W Automotives)  have no responsibility for vehicles that have been worked on prior to arriving at our shop from another Service shop, backyard garage, or customers self-diagnosis and self-repair. If a job has been started and not completed before arriving we (C&W Automotives) have the right to refuse it. We (C&W Automotives) do not warranty any work that was started on by another nor do we (C&W Automotives) warranty any work with customers own parts. If a customer requests specific work done without a diagnosis we (C&W Automotives) do not stand behind customers request of a specific repair, to being the root or the solution to the customer's vehicle and are not held responsible. Examples of customers request would be such as alternator, starter, battery, brakes. At the time of repairing customers request if an issue is evident we (C&W Automotives) will notify the customer to continue work with their knowledge for other work to be done to correct the issue or to notify that we (C&W Automotives) will not be continuing the work due to findings. All vehicles are tested before leaving the shop that repairs have been correctly repaired if you have been notified that your vehicle is ready for pick up then your vehicle has passed the tests of all systems functioning. If something malfunctions in a vehicle due to another issue not pertaining to the direct repair we (C&W Automotives) are not held responsible nor liable due to the negligence of customers maintenance and or aftermarket additions to a vehicle of customers.

        We (C&W Automotives are not the creators of parts installed on a vehicle yet a purchaser as our consumer (you) are, therefore faulty equipment is subject to the Vendor/Manufacturer warranty program.

Disclaimer

        To the maximum extent permitted by applicable law, we (C&W Automotives) exclude all representations, warranties, and conditions relating to our website and the use of this website (including, without limitation, any warranties implied by law in respect of satisfactory quality, fitness for purpose and/or the use of reasonable care and skill). Nothing in this disclaimer will:

        limit or exclude our or your liability for death or personal injury resulting from negligence;

        limit or exclude our or your liability for fraud or fraudulent misrepresentation;

        limit any of our or your liabilities in any way that is not permitted under applicable law; or

        exclude any of our or your liabilities that may not be excluded under applicable law.

        The limitations and exclusions of liability set out in this Section and elsewhere in this disclaimer: (a)

        are subject to the preceding paragraph; and (b) govern all liabilities arising under the disclaimer or in relation to the subject matter of this disclaimer, including liabilities arising in contract, in tort (including negligence) and for breach of statutory duty. To the extent that the website and the information and services on the website are provided free of charge, we (C&W Automotives) will not be liable for any loss or damage of any nature.

Part Warranty

        With any purchased parts we (C&W Automotives) offer a two-year or less warranty depending on vendor/ manufacturer if the part were to malfunction and/or break unless the part is not under warranty by the vendor which will be specified. When a part is warrantied the cost of the part will be waived, but labor fees and taxes must still be paid when claiming your warranted part. Customer’s own parts void (all) warranties.

Hold Harmless Agreement

        We (C&W Automotives) as posted on premises are not responsible for your (customers) vehicle when it's dropped off at the shop overnight, for a daily repair or for multiple days. This is at customers own risk. If vandalism, unexpected weather damage, theft, or random accident caused by a random person happens this is at your (customer’s) loss and not the responsibility nor liability of  C&W Automotives.

Payments

        We (C&W Automotives) Accept payments at our discretion on various types. Any checks that are returned for insufficient funds, or fraudulent activity will be subject to a $30 return check fee per item, plus any and all Attorney and or Legal Fees incurred. Deposits on any work done, is at our discretion and unwilling to pay, we (C&W Automotives) have the right to refuse work to be done. Any work that is authorized via written, verbal, tow in or message wise is due for payment within the time frame of no more than 5 days of work completion otherwise a $15 fee a day will incur as well as any Attorney and or Legal Fees for prosecution of failure to pay.
